This policy applies to all users of Red Brick Markets, including vendors and buyers. It forms part of our Terms of Use.

1. Ownership of Uploaded Content

Vendor Content

  • Vendors retain full ownership of any content they upload to their storefront or product listings.
  • This includes, but is not limited to, photographs, product descriptions, branding, logos, and digital files.

Buyer Content

  • Buyers retain full ownership of any content they upload (e.g. images for personalised or custom products).
  • Uploaded content is used only for the purpose of fulfilling that order. Vendors are not permitted to reuse buyer-uploaded content for any other purpose.

2. Platform Usage Rights (Marketing Licence)

By uploading content to Red Brick Markets, vendors grant Cobble Lane Market Ltd a perpetual, royalty-free, non-exclusive licence to use, reproduce, and adapt that content for the purpose of:

  • Promoting their products
  • Featuring their store in emails, advertising, and on-site content (e.g. homepage, banners)
  • Social media marketing and third-party promotion

❗Vendors cannot opt out of this marketing licence.

Buyers grant Cobble Lane Market Ltd a temporary licence to use uploaded content only as necessary to complete their purchase. Buyer-uploaded files are not used in marketing or redistributed.

3. Automated Deletion of Buyer Uploads

All buyer-uploaded content will be automatically deleted after 9 months of order completion. This applies to:

  • Product personalisation images
  • File uploads submitted through WooCommerce Add-Ons

4. Prohibited Content

You must not upload or list any content that:

  • Infringes any third-party copyright, trademark, or design rights
  • Contains unlicensed stock photography or vectors
  • Depicts celebrities, famous characters, logos, or brand names without permission
  • Is violent, pornographic, sexually explicit, or hateful
  • Violates UK law or the Stripe Prohibited Businesses policy
  • Is misleading, fraudulent, or likely to confuse customers
  • Is generated by AI and not properly tagged/licensed

❗ Vendors are fully responsible for the legality of all content they upload.

5. AI-Generated Content

AI-generated product images or design content (e.g. generated using Midjourney, DALL·E, etc.):

  • Must be clearly tagged as “AI-Generated”
  • Must be fully licensed for commercial use
  • Must not infringe on any person’s likeness, copyright, or trademark

AI-generated product descriptions or listing text do not require a disclosure tag, but must be accurate and lawful.

6. Reporting Intellectual Property Infringement

We take infringement seriously.

If you believe your intellectual property rights have been violated, please contact us:

Please include:

  • A description of the infringing content
  • A link to the listing/store
  • Proof of your IP ownership or licence
  • Your name and contact information

We may:

  • Temporarily hide the reported content
  • Notify the vendor
  • Request a counter-statement
  • Permanently remove the content or terminate the vendor’s account

Repeat offenders will have their accounts suspended or terminated.

7. Platform Disputes Between Vendors

If two vendors dispute ownership of content (e.g., images or branding), we may:

  • Request proof of original ownership or licensing
  • Temporarily remove the disputed content
  • Suspend listings while the issue is resolved

Our decision in these matters is final, and made in the interest of platform integrity.

8. Licensing Warranty (Vendors)

By uploading any content, vendors warrant that:

  • They are the original creator or hold a valid commercial licence
  • Their content does not infringe third-party rights
  • All necessary permissions and clearances have been obtained

9. Indemnity

Vendors agree to indemnify Cobble Lane Market Ltd from any claims, losses, or damages resulting from:

  • Intellectual property infringement
  • Breach of this policy
  • Legal claims made by third parties due to uploaded content

10. Internal Use of Listing Data

By listing products, vendors grant Cobble Lane Market Ltd a licence to use product titles, tags, and metadata for:

  • Search indexing
  • Platform analytics
  • On-site recommendations and filtering

This data will not be republished outside the platform without permission.

This policy protects all creators and ensures the marketplace remains fair, safe, and legal for everyone.
